Welcome to Pirogue.nl (referred to as "we," "us," or "our"). These Terms & Conditions govern your use of our website and the purchase of our unsinkable fibreglass and aluminium commercial open vessels.

By using our website or placing an order with us, you agree to be bound by these Terms & Conditions. Please read them carefully before making any purchase.

2. Company Information

Pirogue.nl is a company based in The Netherlands, specialising in the import and finishing of unsinkable fibreglass and aluminium commercial open boats for tour operators, fishing charters, and commercial work.

3. Orders and Quotations

All orders are subject to acceptance by Pirogue.nl.
Quotations provided by Pirogue.nl are valid for 30 days from the date of issue, unless otherwise stated.
Orders must be confirmed in writing (email or WhatsApp) to be considered valid.
We reserve the right to refuse any order at our discretion.
Custom specifications and optional extras will be quoted separately and confirmed in writing.

4. Pricing and Payment

All prices are quoted in Euros (€) and are exclusive of VAT, unless otherwise stated.
Payment terms are agreed upon confirmation of each order.
A deposit is required before production begins. The remaining balance must be paid before the vessel is shipped.
Payment methods include bank transfer or other agreed payment methods.
Prices are subject to change without notice, but confirmed orders will be honoured at the quoted price.

5. Delivery and Shipping

Delivery timelines are provided in good faith and are based on production schedules and shipping availability.
We will keep you informed of the progress of your order.
Delivery dates are estimates and not guaranteed.
We are not liable for delays caused by factors outside our control (e.g., shipping delays, customs, weather).
Shipping costs are quoted separately and are the responsibility of the buyer.

6. Inspection and Acceptance

Upon delivery, you are responsible for inspecting the vessel.
Any visible damage or discrepancies must be reported to us within 5 business days of delivery.
If you fail to report damage within this period, the vessel will be deemed accepted.
We are not responsible for damage caused during shipping, but we will assist you in making a claim with the shipping carrier if applicable.

7. Returns and Cancellations

Cancellations are accepted only with our prior written consent.
If you wish to cancel an order, you must notify us in writing as soon as possible.
Cancellations may be subject to a cancellation fee to cover costs already incurred (materials, labour, etc.).
Custom-built vessels are non-refundable.

8. Liability

To the fullest extent permitted by law, Pirogue.nl shall not be liable for:

Any indirect, incidental, or consequential damages arising from the use of our vessels.
Loss of profits, revenue, or business opportunities.
Damages caused by misuse, improper maintenance, or unauthorised modifications.

Our total liability for any claim shall not exceed the purchase price of the vessel in question.

9. Warranty

Pirogue.nl provides a limited warranty on the fibreglass and aluminium hull against manufacturing defects.

The warranty period is stated in the purchase agreement.
The warranty does not cover damage caused by misuse, accidents, normal wear and tear, or unauthorised modifications.
Engines, electronics, and third-party components are covered by the manufacturers' own warranties.

10. Intellectual Property

All content on our website, including text, images, logos, videos, and designs, is the property of Pirogue.nl and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or use our content without our prior written permission.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of The Netherlands.

Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of The Netherlands.

We reserve the right to update these Terms & Conditions at any time.
